Our clients trust us to provide reliable end-to-end assistance with our team’s core competencies working to benefit their businesses. For example, a leading watch manufacturing company approached the team for an opinion on launching theme based designer watches in the Indian market. To ensure smooth commercialization of the product without infringing any existing or sooner-to-be patents, our team conducted a Freedom to Operate (FTO) search with an in-depth analysis on the designs and utility patents that were published, registered or granted in India. The unique features of the product were identified and compared with features present in the pre-existing design and utility patents. Consequently, the report was instrumental in allowing the company to commercialize their watches in the Indian market.

Apart from conducting FTO searches for designs, the Intepat IP team is also skilled in carrying out FTO searches for patents. Our team was contacted for assisting a company engaged in manufacturing cosmetic based products. The client aimed to launch specific kits in the United States as well as the Singapore market and wanted to ascertain its viability. The team identified key features of the kit and performed an extensive search and analysis based on patent applications published and granted in the United States as well as Singapore. The team then advised the company to proceed with the commercialization in both the markets on the premise that none of the patent applications individually claimed all the key features of the kit. This was highly beneficial for the company in its expansion process.

Invalidation searches are pivotal in the market for patents, as they can allow or debar commercialization of products. Our team was approached for conducting a patent invalidation search, where a client desired to invalidate a pre-existing granted patent related to tracking location of vehicles. Our team first identified relevant features as per the independent claims of the granted patent. Thereafter, a comprehensive search and analysis was conducted which yielded a positive result. The team concluded and advised the client that the patent could be invalidated in terms of the inventive step and obviousness using a combination of 4 prior art documents. This invalidation search enabled the client to invalidate a granted patent which was hindering the efficient commercialization of their products.

The team collated relevant documents and prepared the necessary arguments to be presented before the UK Trade Marks Office. The end result was fruitful as the Office held the other party’s mark to be in bad faith. Additionally, our client’s mark was registered and costs were awarded in favor of the client. The team was organized, prompt and vigilant in its approach which ultimately resulted in a timely action against an attempt at a malafide registration.
